Question: Hello Company and Attorney. I am the director of a private company, currently my company has 8 employees. I want to ask in this case my company must register the internal work regulations? We hope to receive an early reply from the Lawyer. Sincerely thank you.

Thank you for submitting questions to Khoa Tin Law Firm, on this issue, we would like to answer as follows:

According to the provisions of Clause 1, Article 119 of the Labor Code 2019 regarding the registration of the internal work regulations as follows:

"1. The employer who employs 10 or more employees must register the labor regulations at the labor-specialized agency of the People's Committee of the province where the employer has registered the business.”

Thus, according to the above clause, for enterprises that employ 10 or more employees, they must register the labor regulations at the labor-specialized agency of the provincial People's Committee where the business is registered (the Department of Labor Invalids - Social Affairs of provinces/cities). As for businesses that employ less than 10 employees, this procedure is not required. Your company currently employs 08 employees, so it is not required by law to register the labor regulations at the competent authority.
