Order and procedures for applying for a certificate of registration of vocational education activities
1. Legal grounds
– Law on vocational education dated November 27, 2014;
– Decree 24/2022/ND-CP Amending and supplementing decrees regulating conditions for investment and operation in the field of vocational education;
– Decree 15/2019/ND-CP detailing a number of articles and measures to implement the law on vocational education;
– Decree No. 143/2016/ND-CP stipulating conditions for investment and operation in the field of vocational education;
– Decree 140/2018/ND-CP amending and supplementing decrees related to business investment conditions and administrative procedures under the scope of state management of the Ministry of Labor, War Invalids and Social Affairs.
2. Conditions for granting a certificate of registration of vocational education activities and making decisions on their own to open training professions.
2.1. For elementary level training
Vocational education institutions, vocational education – continuing education centers and enterprises shall be granted a certificate of registration of primary-level vocational education activities when fully meeting the following conditions:
– Having facilities and training equipment suitable to the occupation, scale and level of primary training. The area of theoretical classrooms, rooms and practice workshops used for learning and teaching must be at least 04 m2/classroom on average.
– Having sufficient training programs and textbooks of each occupation registered for operation and must be developed, appraised and promulgated according to regulations of the Minister of Labor, War Invalids and Social Affairs.
– Having a team of qualified teachers, professional qualifications, professional skills and pedagogical skills as prescribed by law; ensure that the maximum ratio of converted students to teachers is 25 students/teacher; There are permanent teachers for the profession of training organization.
2.2. For intermediate and college level training
Colleges are granted certificates of registration of vocational education activities at intermediate and college levels; An intermediate school shall be granted a certificate of registration of vocational education activities at intermediate level when it fully meets the following conditions:
– The professions and occupations registered for vocational education activities are included in the list of vocational training courses at intermediate and college levels promulgated by the Minister of Labor, War Invalids and Social Affairs; consistent with the structure of industries, occupations, training levels and socio-economic development plannings of ministries, branches and localities according to Form No. 01, Appendix V issued together with this Decree.
– In case the name of the training industry or profession is not included in the list of vocational training courses at intermediate or college level promulgated by the Minister of Labor, War Invalids and Social Affairs, intermediate schools or colleges must present a scientific argument for the new training industry or profession; develop a description of the industry or profession and analyze the work of that industry or profession.
– Having physical facilities and training equipment suitable to the industry, profession, scale and level of training, specifically:
+ There are classrooms; laboratory; practice rooms and workshops; experimental production facilities that meet the requirements of teaching, learning and scientific research according to the training program and training scale of each industry or profession. Theoretical classroom area; rooms and workshops for practice and practice used for learning and teaching must be at least 5.5 m2/classroom on average;
+ Having sufficient training equipment of each training branch or profession to meet the list and minimum equipment standards prescribed by the Minister of Labor, War Invalids and Social Affairs. In case the Minister of Labor, War Invalids and Social Affairs has not yet promulgated the list and minimum equipment standards of the professions and occupations registered for vocational education activities, the training equipment must be ensured as prescribed in this Circular. training program and corresponding to the training scale of the registered industry or profession;
+ Having a library with software and equipment for borrowing, searching and studying documents; have sufficient information and materials sources such as books, textbooks, lectures of modules, credits, modules, subjects and related documents to meet teaching and learning requirements;
+ Having enough working rooms, administrative areas and principal offices, ensuring that the organizational structure of specialized departments, faculties and subjects is satisfied, and the area is at least 06 m2/person for intermediate level training. level and 08 m2/person for college level training;
+ There are construction works for cultural, sports and entertainment activities and medical and service works to serve managers, teachers, lecturers and pupils and students.
– There are sufficient training programs and textbooks of each registered profession, developed, appraised and promulgated according to the regulations of the Minister of Labor, War Invalids and Social Affairs.
– Having a contingent of teachers, lecturers and managers in sufficient quantity, suitable to the structure of industries, occupations and training levels; meet the standards, professional qualifications, vocational skills and pedagogical skills as prescribed by law; ensure the implementation of training objectives and programs, in which:
+ The maximum ratio of students/students/teachers and lecturers is 25. The number of permanent teachers and lecturers is guaranteed to receive at least 60% of the program of each training profession;
Foreign teachers and lecturers teaching at intermediate schools, colleges, and higher education institutions with foreign capital must meet regulations on foreign workers working in Vietnam. in accordance with the laws of Vietnam.
3. Application for registration of vocational education activities
3.1. For public and private vocational education institutions
Dossier for registration of vocational education activities, including:
– Written registration of vocational education activities;
– Report on the conditions for ensuring vocational education activities and enclosed with supporting documents.
3.2. For foreign-invested vocational education institutions
Dossier for registration of vocational education activities shall be made in Vietnamese or Vietnamese and English, including:
– Written registration of vocational education activities;
– A copy of the investment registration certificate (if any);
– Report on the conditions for ensuring vocational education activities and enclosed with supporting documents.
3.3. For vocational training institutions
Dossier for registration of vocational education activities, including:
– Written registration of vocational education activities;
– A copy of the decision on establishment or approval of establishment or the certificate of enterprise registration or the certificate of investment registration (if any);
– Report on the conditions to ensure vocational education activities and attach proofs;
– A copy of the charter or regulations on organization and operation.
4. Order and procedures for registration and issuance of certificates of vocational education activities
For intermediate schools, vocational and business education centers:
– Send 01 set of application for registration of vocational education activities to the Department of Labor, War Invalids and Social Affairs where the head office of the institution is located. In case of registration for vocational education activities at a branch or training location other than the same province or centrally run city where the head office is located, 01 set of application for registration of vocational education activities shall be sent to Department of Labor, War Invalids and Social Affairs where the branch is located, and other training locations of the establishment;
– Within 10 working days from the date of receipt of complete and valid dossiers, the Department of Labor, War Invalids and Social Affairs shall examine the conditions for ensuring vocational education activities and issue registration certificates. vocational education activities according to the form in Appendix VII issued with this Decree; in case of refusal to issue a certificate of registration of vocational education activities, within 05 working days, it must reply in writing and clearly state the reason;
– Within 05 working days from the date of issuance of the certificate of registration of vocational education activities, the Department of Labor, War Invalids and Social Affairs shall send a copy of the certificate of registration of vocational education activities to the General Department of Labor. 5. Competence to issue certificates of registration of vocational education activities
The Department of Labor, War Invalids and Social Affairs shall issue certificates of registration of vocational education activities to intermediate schools, vocational education centers, vocational education and continuing education centers and enterprises.
