– Decree 109/2016/ND-CP dated July 1, 2016 stipulating the granting of practice certificates to practitioners and the granting of operation licenses to medical examination and treatment establishments;

– Decree 155/2018/ND-CP dated November 12, 2018 amending and supplementing a number of regulations related to business investment conditions under the state management of the Ministry of Health.

2. Conditions for applying for a license

According to Article 43 of the 2009 Law on Medical Examination and Treatment, the conditions for granting operation licenses to medical examination and treatment establishments are as follows:

– First, meet the provisions of the national technical regulations on medical examination and treatment establishments promulgated by the Minister of Health;

– Second, there are enough practitioners suitable to the scope of professional activities;

– Thirdly, the person in charge of professional and technical expertise of the medical examination and treatment establishment must have practiced medical examination and treatment for at least 36 months.

In addition, in case of registration of establishment of a specialized clinic or family doctor, in addition to the conditions specified above, the head of the establishment must be a practitioner with professional qualifications suitable to the type of practice. .

3. Profile composition

– An application for an operation license, made according to Form 01 Appendix XI issued together with Decree 109/2016/ND-CP;

– Certificate of enterprise registration or investment certificate, for foreign-invested medical examination and treatment establishments;

– The practice certificate of the person in charge of professional and technical expertise of the medical examination and treatment establishment; the person in charge of the specialized section of the medical examination and treatment establishment;

– List of registered practitioners at medical examination and treatment establishments (including registration of practitioners and people working in medical profession at the establishment but not subject to the issuance of practice certificates) according to the prescribed form. in Appendix IV issued together with Decree 109/2016/ND-CP;

– A declaration of physical facilities, medical equipment, organization and personnel of the medical examination and treatment establishment according to Form 02, Appendix XI issued together with Decree 109/2016/ND-CP;

– Documents proving that the medical examination and treatment establishment meets the conditions on physical foundations, medical equipment, and personnel organization suitable to the scope of professional activities;

– Charter of organization and operation;

– The list of professional and technical expertise of the medical examination and treatment establishment proposed on the basis of the list of professional and technical expertise promulgated by the Minister of Health.

4. Order and procedures for implementation

Step 1: Submit your application

To apply for a license to operate a private clinic, you must first submit an application in person or send it by post to the Department of Health at the place where the medical examination and treatment facility is located.

– In case of direct submission: The receiving agency records the receipt for the applicant;

– In case of submission by post: within 03 days from the time of receiving the application, the receiving agency shall send the application receipt to the applicant.

Step 2: Receive and process the application

– In case the application is valid: The receiving agency must issue an operation license to the business establishment within 45 days from the date written on the application receipt.

– In case the dossier is invalid: The application-receiving agency must send a written notice to the applicant for the operation license to complete the dossier within 10 days from the date on which the application is received. profile.
