1. Legal grounds
– Law on Tourism 2017;
– Decree 168/2017/ND-CP detailing a number of articles of the Law on Tourism;
– Decree 94/2021/ND-CP amending and supplementing Article 14 of the Government’s Decree No. 168/2017/ND-CP dated December 31, 2017 detailing a number of articles of the Law on Tourism on levels deposit for travel service business;
– Circular 06/2017/TT-BVHTTDL detailing a number of articles of the Law on Tourism.
2. Conditions for being granted a domestic travel service business license
According to the provisions of Clause 3, Article 31 of the Law on Tourism 2017, an enterprise is granted a license to provide domestic travel services when it meets the business conditions specified in Clause 1, Article 31 of the Law on Tourism 2017, specifically:
2.1. An enterprise established in accordance with the law on enterprises.
2.2. Deposit for domestic travel service business at the bank. According to the provisions of Decree 94/2021/ND-CP, the deposit level is regulated differently in 2 phases:
– Phase 1: From now until the end of December 31, 2023, the deposit level specified in Article 1 of Decree 94/2021/ND-CP is VND 20,000,000 (twenty million);
– Phase 2: From January 1, 2024, the deposit level for domestic travel service business shall comply with the provisions of Clause 2, Article 14 of Decree No. 168/2017/ND-CP, specifically 100,000. 000 (one hundred million) dong.
2.3. The person in charge of the travel service business must have an intermediate or higher degree in tourism; If you graduate from an intermediate or higher degree in another major, you must have a certificate of domestic tourism operations.
– Person in charge of business: According to the provisions of Clause 1, Article 3 of Circular 06/2017/TT-BVHTTDL, the person in charge of travel service business is the person holding one of the following titles: Chairman of the Board of Directors ; the chairman of the members’ council; company president; private business owners; general manager; director or deputy director; Head of travel service business.
– Specialized in travel: According to the provisions of Clause 2, Article 3 of Circular 06/2017/TT-BVHTTDL, major in travel includes one of the following majors: (a) Management of tourism and travel services onion; (b) Travel Administration; (c) Tour operator; (d) Tourism Marketing; (d) Tourism; (e) Travel and tourism; (g) Tourism business and management.
– Certificate of domestic tourism operations: The content of training, fostering, organizing exams and granting certificates of domestic tourism operations is regulated by the Ministry of Culture, Sports and Tourism in Circular 06/2017. /TT-BVHTTDL.
3. Dossier of application for a domestic travel service business license
Pursuant to Clause 1, Article 32 of the 2017 Tourism Law, an application file for a domestic travel service business license includes:
– An application form for a travel service business license, made according to form No. 04, Appendix II issued together with Circular 06/2017/TT-BVHTTDL;
– A certified copy of the Business Registration Certificate;
– Certificate of deposit for travel service business;
– A certified copy of the appointment decision or the labor contract between the travel service business and the person in charge of the travel service business;
– A certified true copy of the diploma or certificate of the person in charge of the travel service business.
4. Order, procedures and competence to grant domestic travel business licenses
According to the provisions of Clause 2, Article 32 of the Law on Tourism 2017, the order, procedures and competence to grant a domestic travel service business license are prescribed as follows:
Step 1: The enterprise applying for a license to provide domestic travel services shall submit 01 application to the specialized tourism agency of the province where the enterprise is located.
Step 2: Within 10 days from the date of receiving the valid dossier, the specialized tourism agency of the province shall appraise and grant the domestic travel service business license to the enterprise; In case of refusal, it must be notified in writing and clearly state the reasons therefor.
