Procedures for correcting the contents of the granted land use right certificate

1. Legal basis of administrative procedures

– Law on Land No. 45/2013/QH13 dated November 29, 2013;

– Decree No. 43/2014/ND-CP dated May 15, 2014 of the Government detailing the implementation of a number of Articles of the Land Law 2013;

– Circular No. 24/2014/TT-BTNMT dated May 19, 2014 of the Ministry of Natural Resources and Environment on regulations on cadastral records;

– Circular No. 23/2014/TT-BTNMT dated May 19, 2014 of the Ministry of Natural Resources and Environment on regulations on certificates of land use right, ownership of houses and other assets attached to land; – Circular No. 02 /2014/TT-BTC dated January 2, 2014 of the Ministry of Finance Guidance on fees and charges falling under the decision-making authority of the People’s Councils of the provinces and centrally-run cities.

2. Order of execution

– Land users shall submit dossiers at the Department of receiving dossiers and returning results, hereinafter referred to as the “one-stop shop” section of the district-level People’s Committees.

In case the land use right registration office at district level detects that there are errors in the issued Certificate, Certificate of House Ownership, Certificate of Ownership of Construction Works, it shall notify such to the land user. know and request the land user, the owner of the property on land to submit the issued Certificate for correction.

– The district-level land use right registration office is responsible for checking; make a record of conclusions on the contents and causes of errors; make a dossier and submit it to the competent authority for correction in the issued Certificate with errors; at the same time correcting incorrect contents in cadastral records and land databases.

In case of correction and the certificate holder requests to change it to the Certificate of land use rights, ownership of houses and other land-attached assets, the land use right registration office shall submit it to the competent authority. competent to grant certificates of land use rights and ownership of houses and other land-attached assets.

– The land use right registration office at district level shall grant certificates to land users and owners of assets attached to land.

– Time to receive documents: Office hours on working days of the week

3. How to do it

The land user submits the application for correction of the Certificate of the “one-stop shop” division under the district-level People’s Committee

a) Composition, number of records

* Profile composition includes:

– The original of the issued Certificate.

– An application for correction of the Certificate in case errors are detected due to the fault of the land user or owner of property on land.

* Number of records: 01 set

b) Time limit for settlement

No more than 15 working days from the date of receipt of valid dossier.

For mountainous communes and regions with difficult socio-economic conditions, the implementation time may be increased by 15 days.

Results of settlement of administrative procedures must be returned to land users and owners of property on land within 03 working days from the date of receipt of settlement results.

c) Subjects carrying out administrative procedures

Households, individuals, residential communities and overseas Vietnamese may own houses associated with residential land use rights in Vietnam.

d) Agency carrying out administrative procedures

– Authority competent to decide: People’s Committee of district.

– The agency directly implementing administrative procedures: District land use right registration office.

– Coordinating agency (if any): Department of Natural Resources and Environment.

e) Results of administrative procedures

– Record in the cadastral book and make a dossier for the State to manage.

– Certificate.
