1. Legal grounds
– Law on Tourism 2017;
– Decree 168/2017/ND-CP detailing a number of articles of the Law on Tourism;
– Decree 94/2021/ND-CP amending and supplementing Article 14 of the Government’s Decree No. 168/2017/ND-CP dated December 31, 2017 detailing a number of articles of the Law on Tourism on levels deposit for travel service business;
– Circular 06/2017/TT-BVHTTDL detailing a number of articles of the Law on Tourism.
2. Conditions for being granted an international travel service business license
According to the provisions of Clause 3, Article 31 of the Law on Tourism 2017, an enterprise is granted an international travel service business license when it meets the business conditions specified in Clause 2, Article 31 of the Law on Tourism 2017, specifically:
2.1. An enterprise established in accordance with the law on enterprises.
2.2. Deposits for international travel service business at banks: According to the provisions of Decree 94/2021/ND-CP, the deposit level is regulated differently in 2 stages:
– Phase 1: From now until the end of December 31, 2023, the deposit level is specified in Article 1 of Decree 94/2021/ND-CP, specifically as follows:
Business travel services for international tourists to Vietnam: 50,000,000 (fifty million) VND;
Business travel services for tourists going abroad: 100,000,000 (one hundred million) dong;
Business travel services for international tourists coming to Vietnam and tourists going abroad: 100,000,000 (one hundred million) VND”.
– Phase 2: From January 1, 2024, the deposit level for international travel service business shall comply with Clause 2, Article 14 of Decree No. 168/2017/ND-CP, specifically:
Business travel services for international tourists to Vietnam: 250,000,000 (two hundred and fifty million) VND;
Business travel services for tourists going abroad: 500,000,000 (five hundred million) VND;
Business travel services for international tourists to Vietnam and tourists going abroad: 500,000,000 (five hundred million) VND.
2.3. The person in charge of the travel service business must have a college degree or higher, majoring in travel; If you graduate from a college or higher in another major, you must have an international tourism management certificate.
– Person in charge: According to Clause 1, Article 3 of Circular 06/2017/TT-BVHTTDL, the person in charge of travel service business is the person holding one of the following titles: chairman of the board of directors; the chairman of the members’ council; company president; private business owners; general manager; director or deputy director; Head of travel service business.
– Specialized in travel: According to the provisions of Clause 2, Article 3 of Circular 06/2017/TT-BVHTTDL, major in travel includes one of the following majors: (a) Management of tourism and travel services onion; (b) Travel Administration; (c) Tour operator; (d) Tourism Marketing; (d) Tourism; (e) Travel and tourism; (g) Tourism business and management.
– International travel professional certificate: The content of training, fostering, organizing exams, granting certificates of international tourism operations is regulated by the Ministry of Culture, Sports and Tourism in Circular 06/2017 /TT-BVHTTDL
3. Dossier of application for an international travel service business license
Pursuant to Clause 1, Article 33 of the Law on Tourism 2017, an application file for an international travel service business license includes:
– An application form for a travel service business license, made according to form No. 04, Appendix II issued together with Circular 06/2017/TT-BVHTTDL;
– A certified true copy of the Certificate of Business Registration or the Certificate of Investment Registration issued by a competent state agency;
– Certificate of deposit for travel service business;
– A certified true copy of the diploma or certificate of the person in charge of the travel service business; or a certified true copy of a college degree or higher in another major and a certified true copy of the certificate of international tourism operations. Diplomas granted by foreign training institutions must be recognized according to regulations of the Ministry of Education and Training, the Ministry of Labor, War Invalids and Social Affairs;
– A certified copy of the appointment decision or the labor contract between the travel service business and the person in charge of the travel service business.
4. Order, procedures and competence to grant an international travel service business license
According to the provisions of Clause 2, Article 33 of the Law on Tourism 2017, the order, procedures and competence to grant an international travel service business license are prescribed as follows:
– The enterprise applying for an international travel service business license shall submit 1 set of documents to the Vietnam National Administration of Tourism;
– Within 10 days from the date of receipt of a valid application, the Vietnam National Administration of Tourism shall appraise and grant an international travel service business license to the enterprise and notify the provincial-level specialized tourism agency. where the enterprise is headquartered; In case of refusal, it must be notified in writing and clearly state the reasons therefor.
