I. Conditions for establishing a business household

1. Conditions on business household name

The naming of a business household must include the following two elements:

– Type of “Household business”.

– The business household’s proper name (proper name is written with the letters of the Vietnamese alphabet, the letters F, J, Z, W, possibly accompanied by numbers and symbols).

In addition, the name of the business household must not violate the prohibitions, must not have the same name and must not cause confusion as prescribed in Clauses 2, 3, 4, Article 88 of Decree No. 01/2021/ND-CP on business registration.

2. Subject conditions

Individuals and household members who are Vietnamese citizens have the right to establish business households in Vietnam, except for the cases specified in Clause 1, Article 80 of Decree No. 01/2021/ND-CP on business registration. Prohibited conditions can be generalized into 3 groups:

• Subject groups do not have civil act capacity and civil legal capacity.
• A group of subjects deprived of their rights by law.
• Groups of subjects in other cases as prescribed by relevant laws.

3. Conditions on business lines

Business lines must match the industry code level 5 in the national economic industry system. For conditional occupations, the conditions prescribed by law must be satisfied in order to be established (For example: conditions on practice certificates, conditions on practice licenses, conditions on legal capital, etc.) , other conditions).

II. Components of the application file for establishment of a business household

a) Application for business household registration

b) Legal documents of the individual, for the head of the business household, the household member registering the business household in case the household members register the business household.

c) Copies of the following papers:

– Minutes of meeting of household members on the establishment of business households in case household members register business households.

III. Order and procedures for setting up a business household

Step 1: The individual or the representative of the household submits a business household registration application at the People’s Committee of the district where the business location is located.

Step 2: Receipt and examination of documents The People’s Committee of the District receives, examines the application and gives a receipt on receipt of the application to the applicant.

Step 3: Review and process the application:

– In case the application is valid: Within 03 working days from the date of receipt of the application, the Finance – Planning Department under the People’s Committee of the District shall issue the Certificate of Business household registration to the business household. .

– In case the application is not valid: Within 03 working days from the date of receipt of the application, the Department of Finance – Planning under the People’s Committee of the District must clearly notify the content that needs to be amended and supplemented in writing. documents for business household founders.

Step 4: Individuals or representatives of households, based on the appointment date on the application receipt, come to receive the settlement results at the People’s Committee of the district where the business is located.

IV. Result of the procedure

The result of carrying out the procedure is the Certificate of Business Household Registration.
