1. Postal service business conditions
Pursuant to Clause 1, Article 21 of the 2010 Postal Law, a mail service provider with a receiving address weighing up to 2 kilograms (kg) must have a postal service business license (hereinafter referred to as a postal service business license). postal) issued by a competent state agency in charge of postal services.
2. Conditions for granting a postal license
Clause 2, Article 21 of the 2010 Postal Law provides:
Enterprises that are granted a postal license need to meet the following conditions:
– Having a business registration certificate (with postal operation registration) or an investment certificate in the postal sector;
– Having financial capacity as prescribed;
– For the case of providing postal services within the province, inter-province, the enterprise must have a minimum capital of 02 billion Vietnam dong;
– For the case of providing international postal services, the enterprise must have a minimum capital of 05 billion Vietnam dong;
– Having personnel suitable to the business plan according to the contents of the license application;
– Having a feasible business plan in line with regulations on postage rates and quality of postal services;
– Take measures to ensure information security and safety for people, postal items and postal networks.
3. Implementation procedure
3.1. About the documents to be submitted
Clause 2, Article 6 of Decree 47/2011/ND-CP, an application for a postal license includes:
– Application letter for postal license.
– A copy of the postal business registration certificate or the investment certificate for postal operations in Vietnam, stamped and certified by the enterprise itself and is responsible for the accuracy of the copy;
– Charter of organization and operation of the enterprise (if any);
– Business plan;
– Form of contract for the supply and use of postal services in accordance with the provisions of the law on post;
– Samples of logos, trademarks, special symbols or elements of the enterprise’s identification system displayed on postal items (if any);
– List of postal service charges in accordance with the provisions of the law on post;
– Postal service quality standards announced to be applied in accordance with the provisions of the law on post;
– Regulations on the limit of liability to compensate for damage in case of damage, the process of customer complaint settlement, and the time limit for complaint settlement in accordance with the provisions of the law on postal services;
– Agreement with other enterprises, foreign partners in Vietnamese, for the case of cooperation in the supply of one, several or all stages of the postal service requested for a license;
– Consular legalized documents proving the foreign partner’s legal status.
3.2. About the procedure for applying for a license
Pursuant to Article 8 of Decree 47/2011/ND-CP, amended and supplemented by Clause 6, Article 1 of Decree 25/2022/ND-CP, the order and procedures for applying for a postal license are prescribed as follows:
Step 1: Enterprises or organizations applying for a postal license shall send a dossier to the Department of Information and Communications of the province or city where the business operates if applying for a license for postal service provision. within the province; The Ministry of Information and Communications, if applying for a license to operate in the inter-provincial or international scope
Step 2: Receipt of application
Within 03 working days from the date of receipt of the dossier, the competent state agency shall send a receipt of the dossier to the enterprise’s email address (e-mail).
Step 3: Issuing a postal license
Within 30 days from the day on which the application is received, the state agency competent to receive and process the application will be responsible for granting a postal license.
